Sean Drury Photography – Terms & Conditions
1. Booking Confirmation & Retainer
1.1 A non-refundable retainer of 50% of the total package price is required to lock in your date with Sean Drury Photography (SDP).
1.2 Until the retainer is paid, your booking is not confirmed and the date remains available to others.
1.3 Once the retainer is received, your date is exclusively reserved — no other bookings will be taken for that time.

2. Final Payment
2.1 The remaining balance is due no later than 7 days before your scheduled shoot or event.
2.2 Final images will not be delivered until full payment has been received.
2.3 Payment methods and banking details will be provided upon booking.

3. Cancellations, Rescheduling & Refunds
3.1 For regular sessions (non-wedding, non-event): Minimum 24 hours’ written notice is required to reschedule.
3.2 Same-day cancellations will result in full forfeiture of the retainer and any payments made, unless otherwise agreed in writing.
3.3 For weddings and event bookings: The retainer remains non-refundable under all circumstances. Cancellations made within 7 days of the event will result in loss of the full amount paid.
3.4 In the event of extreme weather, SDP will work with you to reschedule or adapt the plan on the day.
3.5 If SDP is unable to attend due to illness, injury, or an unforeseen emergency, all efforts will be made to arrange a suitable replacement photographer. If one cannot be sourced, a full refund (including retainer) will be issued.
3.6 SDP is not responsible for costs the client has already incurred (e.g. venue, permits, travel).

4. Session Timing & Late Arrivals
4.1 Sessions begin strictly at the scheduled time. If you're late, that time is lost — no extensions.
4.2 To extend a session past the scheduled time, the rate is $550 per hour (or part thereof), billed in addition to your original package.

5. Additional Costs
5.1 The following additional charges may apply and will be added to your invoice if applicable:

Travel outside the included area: $1 per kilometre

Tolls and parking

Permit or location fees

Accommodation for distant or overnight shoots

Rush image delivery (optional): $130

6. Image Delivery
6.1 Images are delivered via an online gallery within 1–4 weeks after the session date.
6.2 A rush delivery option is available for $130, depending on workload.
6.3 Clients will have 14 days to download their images before the gallery expires.
6.4 SDP is not responsible for the print quality of products ordered through third-party printers.

7. Editing Style & Artistic Integrity
7.1 By booking with SDP, the client agrees to the editing style and artistic vision provided.
7.2 No additional body reshaping or excessive retouching will be performed.
7.3 Clients must not apply filters, alter colours, or manipulate images in any way.
7.4 If you need changes, talk to me directly — don’t DIY.

8. Copyright & Usage
8.1 All images remain the copyright and intellectual property of Sean Drury Photography.
8.2 Clients are granted a non-exclusive, non-transferable licence for personal use — sharing online, printing, and personal displays are all okay.
8.3 Commercial use, resale, or publication without written consent is prohibited.
8.4 SDP may use images for marketing, portfolio, awards, competitions, or promotional material, unless you request otherwise in writing before the shoot.

9. Public Liability & Responsibility
9.1 SDP holds full public liability insurance and complies with all legal safety requirements for professional photography.
9.2 While every care is taken during sessions, SDP is not liable for any injury, accident, or damage occurring during the shoot.
9.3 Clients agree to indemnify SDP for any claims or losses arising from their breach of these terms.

10. Governing Law
10.1 These terms are governed by the laws of New South Wales, Australia.
10.2 Any disputes will be handled under the exclusive jurisdiction of the courts of NSW.

11. Agreement Acknowledgement
By proceeding with a booking or making payment, you confirm that you have read, understood, and accepted the above terms and conditions in full.
